Terms of Service

Welcome to Somniar. By downloading, installing, or using the Somniar mobile application ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. Entertainment Purpose Only

Somniar is designed for entertainment, self-reflection, and personal curiosity. Somniar is NOT a medical device, diagnostic tool, psychological service, or healthcare provider. Dream interpretations provided by the App should not be used as a substitute for professional medical, psychological, or therapeutic advice.

If you experience distressing dreams, sleep disorders, or mental health concerns, please consult a qualified healthcare professional.

2. Eligibility

You must be at least 13 years old to use Somniar. If you are between 13 and 18, you must have parental or guardian consent to use the App.

3. Account and Authentication

Somniar uses Google Sign-In and Apple Sign-In for secure account management. You are responsible for maintaining the security of your device and account credentials. You may delete your account at any time from within the App.

4. Subscriptions and Payments

• Somniar requires a paid subscription to use. We offer a Monthly plan ($4.99/month) and a Yearly plan ($29.99/year).
• All new subscriptions include a 3-day free trial. You will not be charged during the trial period.
• Subscriptions are auto-renewable and are processed through Apple App Store or Google Play Store.
• You may cancel your subscription at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple or Google according to their respective refund policies.
• Prices may change with reasonable notice. Existing subscribers will be notified before any price increase applies to their subscription.

5. Permitted Use

You agree to use Somniar solely for personal, non-commercial purposes. You may not:

• Reverse-engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems or other users' data
• Use the App to generate content that is illegal, harmful, or violates the rights of others
• Redistribute, resell, or sublicense access to the App

6. AI Processing

Dream analysis is powered by AI technology (Anthropic and/or OpenAI, via OpenRouter). When you request an analysis, your dream text, mood, and analysis context are sent to the AI providers for processing. The AI providers do not store your content after analysis is complete and do not use your data to train models.

7. Intellectual Property

All content within the App, including dream dictionaries, UI design, and software, is owned by Somniar and protected by intellectual property laws. You retain ownership of your personal dream entries and analysis results.

8. Disclaimer of Warranties

Somniar is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that dream interpretations will be accurate or meaningful for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Somniar's total liability to you for any claims arising from your use of the App shall not exceed the amounts you have paid to Somniar in the twelve (12) months preceding the claim.

Somniar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to emotional distress arising from dream interpretations.

10. Indemnification

You agree to indemnify and hold harmless Somniar from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time. Upon termination, your right to use the App ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws, without regard to conflict of law principles.
